Please read these terms and conditions carefully before using Moser Atelier.
Acknowledgment
These are the Terms and Conditions governing the use of this Service and the agreement that operates between you and Moser Atelier. These Terms and Conditions set out the rights and obligations of all users regarding the use of the service.
Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the service.
By accessing or usingMoser Atelier you agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Creating a Moser Atelier Account
You may need to create a Moser Atelier account to use all of it’s services. Your username and password are for your personal use only and should be kept confidential. You understand that you are responsible for all use, and unauthorized use, of your username and password. Notify Moser Atelier team immediately if your username or password is lost or stolen.
Price Changes
Moser Atelier may from time to time make changes to the annual membership cost. Price changes will take effect at the start of the next subscription period following the date of the price change. If you do not agree to a price change, you can cancel your membership prior to the renewal date. Continuing to use Moser Atelier after the price change takes place will equate to acceptance of the new price.
Refund Policy
Donations: Moser Atelier is grateful for your donation and support of our mission. Moser Atelier’ financial health and budget are reliant on generous donations such as yours, for this reason we are unable to refund donations at this time.
Membership Fee: Moser Atelier is proud of the community and resources we offer to our members. This program is made possible by the annual cost of membership. We are unable to refund the membership fee.
Merchandise: Moser Atelier will accept returns and exchanges of merchandise within 30 days of shipping. Items must be returned in the condition in which you received or will be subject to denial. Customer is responsible for return shipping fees.
Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.
Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of Moser Atelier and any of its suppliers under any provision of this Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you through the service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall Moser Atelier or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the service, or otherwise in connection with any provision of this Terms), even if Moser Atelier or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.
"AS IS" and "AS AVAILABLE" Disclaimer
The service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Moser Atelier, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Moser Atelier provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither Moser Atelier nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
Governing Law
The laws of The United States, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
Disputes Resolution
If you have any concern or dispute about the service, You agree to first try to resolve the dispute informally by contacting the Company.
For European Union (EU) Users
If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if we have made them available to you on our service. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Licensing Agreement for Mini Courses & Moser Atelier Templates
This Agreement is entered between Moser Atelier, LLC, any of their affiliates (“Moser Atelier”), and the person or entity responsible for the purchase. ( “Purchaser”/ “you”)
General.
SMoser Atelier templates are intended for use with Squarespace websites, and the Moser Atelier mini courses are intended to serve as tutorials and instructional material. Any content added by you into Moser Atelier Templates is considered User Content (“User Content”).
1 | Proprietary Rights Except for your User Content, the Templates and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, (the “Moser Atelier Content”), and all Intellectual Property Rights related thereto, are the exclusive property of Moser Atelier. Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a grant of ownership or other right beyond basic commercial license to any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any Moser Atelier Mini-Course for educational, consulting, or other teaching formats. Notwithstanding the foregoing, Moser Atelier hereby grants you the license to incorporate the Content into new commercial products created by you as derivative works of the Code and Templates provided by Moser Atelier in the form of done-for-you websites or web design services. Use of the Moser Atelier Content for any purpose not expressly permitted by this Agreement is strictly prohibited.
2 | Moser Atelier Property Access to the Moser Atelier Template represents a limited license right governed solely by the terms of this Agreement and available for distribution at Moser Atelier’s sole discretion. All materials including the organization and presentation of such material in creating the template is the property of Moser Atelier may be protected by intellectual property laws including laws relating to copyrights, trademarks, trade names, internet domain names, and other similar rights.
3 | Paid Services
3.1 Add-on Services.
Any additional services, such as installing templates, customizing templates, installation of mini-course features. and other services requested by you and not covered by this agreement are not included in the current pricing and will incur additional charges.
3.2 No Refunds.
There are no refunds for the cancellation of your order. In the event that Moser Atelier suspends or terminates this Agreement, you understand and agree that you shall receive no refund or exchange for any credits or licenses.
4| Third-Party Links and Accounts
The Content may contain links to third-party apps or websites to install and use the Content that is not owned or controlled by Moser Atelier. You understand that the Content provided by Moser Atelier is only compatible with Squarespace. You further agree that this agreement does not grant you access to those websites. It is your responsibility to determine the website that best suits your needs, and you are responsible for obtaining and maintaining such accounts with those websites.
Moser Atelier does not endorse or assume any responsibility for any such third-party apps, sites, information, materials, products, or services. If you utilize a third-party app or website to use the templates, you do so at your own risk, and you understand that this Agreement and Moser Atelier’s Privacy Policy do not apply to your use of such sites. Please ensure you read and agree to the Terms and Conditions of the app or website. You expressly relieve Moser Atelier from any and all liability arising from your use of any third-party app, website, service, or content.
5 | Loss by Third Party Sites.
Additionally, your dealings with third parties, including payment and delivery of goods and any other terms (such as warranties), are solely between you and such third parties. You agree that Moser Atelier shall not be responsible for any loss or damage of any sort relating to your dealings with such third parties.
6 | Restrictions on Use of products
6.1 Mini-course guidelines
In addition to the above guidelines, the following guidelines relate to purchasing and using the Moser Atelier mini-courses.
By purchasing this product, you (“Purchaser”) agree to the following terms stated herein. Moser Atelier agrees to provide the Moser Atelier mini-course, and Purchaser agrees to abide by all policies and procedures as outlined in this agreement. The information provided in the Moser Atelier mini-course is proprietary, copyrighted, and developed solely and specifically for Moser Atelier. The original information included in the mini-course is for the purchaser’s individual use only and is a single-user license. Participant agrees that such proprietary material is solely for Purchaser’s own use. Any disclosure, reproduction, and sale by Participant to a third party is strictly prohibited. If the purchaser is an organization, the purchaser is prohibited from sharing or distributing login information across the organization. Each user must obtain individual log-in information. Moser Atelier grants the purchaser permission to apply the mini-courses to multiple websites except for commercial production, such as inclusion in templates.
6.2 No sharing
The purchaser is prohibited from using Moser Atelier information obtained from the mini-course and templates to teach or instruct third parties about using Moser Atelier products. Additionally, the purchaser is prohibited from directly or indirectly sharing or distributing Moser Atelier codes to any third party not licensed or authorized by Moser Atelier. For the sake of clarity, login information, downloadable templates, and other Content from Moser Atelier are limited to the sole unique individual identified at the time of purchase. In the event of purchase on behalf of an organization, each individual use of the Content shall require a unique account and login confirming purchase and license for the use.
6.3 Template Guidelines
The use of Moser Atelier templates by individuals and organizations is limited to use in association with one (1) website. A new template must be purchased for each additional website an individual or organization wishes to utilize the content associated with.
7. Technical Support
Included with the purchase is lifetime access to the templates and mini-courses and updates to code. The company offers 30 days of support beginning on the date of your purchase. Within this period, you are entitled to a reasonable amount of help from us—the definition of which will be determined by Moser Atelier at our sole discretion.
Requests for support must only be made by submitting a ticket. We aim to answer your questions within 72 hours during weekdays, but please understand that this may take longer for more technical problems or peak periods.
For mini-courses, the style customizations beyond what's shown in our demo projects and tutorials are quoted separately. Moser Atelier cannot guarantee that our plugins or mini-courses are compatible with other plugins from other providers.
We assist in the following areas of concern on templates:
Pre-installation of our website templates
Clarification on our template features or settings
Effects of Squarespace updates on our templates
General template bug fixes and patches
However, take note that our support does not cover the following:
General Squarespace questions and issues
Design strategy or guidance on template use
Compatibility with third-party plugins
Issues from modifications of custom code or functionality
Server or hosting configurations
Upon submitting a ticket, be prepared to present your proof of purchase to confirm your order.
We reserve the right to suspend or deny our support services without notice to anyone who disrespects our support team. We will also not tolerate unreasonable demands or abuse of our support system.
